حكم الأبنية بين الشريعة والقانون

ABSTRACT

This study seeks to investigate the reality of construction and the position of Islam, compared to that of law, with respect to this process.   Life witnesses a vast process of construction and an overwhelming technological development.   These processes are associated with the erection of very high building and the creation and digging of huge holes in the ground.   It is of paramount importance to investigate the position of Islam and law with respect to the process of construction and its negative consequences, such as keeping the sun-rays off the neighboring building, the creation of vintalation problems and the contiguity of building.

ملخص

تهدف هذه الدراسة إلى الوقوف على حقيقة البناء وشرعية العمران في الإسلام مقارناً بالقانون.   وخصوصاً ونحن نشهد مثل هذا التقدم العمراني الهائل، والتطور التكنولوجي العظيم في وقتنا الحاضر.   فأردت من هذه المحاولة بيان وجهة نظر الشريعة الإسلامية في التطاول في البناء إلى عنان السماء وشقه إلى أعماق الأرض، وموقف القانون من ذلك.   وبعبارة أخرى، هل التسابق في بناء المساكن والدور مع ما يصاحبه من اعتداءات كثيرة على الإنسان من حيث حجب الضوء والشمس وإغلاق منافذ الهواء، وتلاصق البناء وغيره جائز في الشريعة والقانون؟   هذا ما سنرى وبالله التوفيق .
